The best defense in this case is the truth, no matter who it hurts. He needs to establish the fact that he was just renting space to the guy, and if he has anything in writing which indicates his effort to remove him from the premises he needs to give it to his attorney to show his true intent in this matter. Either that or have the guilty parties tell the authorities that he had nothing to do with the issue.
he has to be able to prove that he didn’t know the guy was doing it in order to get out of it. in most states, if it’s done on your property then you are liable. for example: my grandparents own about 150 acres that are in a rural area of the state and their is no residence on the property. however, they recieved notice that if drugs were found on the property (such as someone planted a pot plant or something) then they would be responsible because they own the property. whoever owns the property is charged with maintaining a safe and legal environment. sucks, but its true. he needs a really good attorney. if he’s already on probabtion, then he’s probably screwed, since with probation you aren’t supposed to be in the company of “unsavory characters”.
